E.M.Shtrbevska: The Cham-
ber suggests concrete solution for
amendment of Article 211 of the
Law on Enforcement which should
provide effective collection of
claims, which the companies have
on the mentioned subjects, and that
is the suggestion to add a new para-
graph in the Article 211, accord-
ing to which as objects and rights
(the way they are stipulated in the
abovementioned cited article) shall
not be considered the funds which
are on the accounts with carri-
ers of payment operations, and an
enforcement without any kind of
constraint can be carried out over
them.”
We think that with this solution
it would be enabled the Article 211
of the Law on Enforcement to fulfill
its purpose in future, at the same
time without creating additional
consequences on the payment of
the claims of the business subjects,
which derived in the framework
of concluded agreements for deliv-
ered goods or given services for the
needs of the units of the local self- Chamber and the fact that all our
government, the public companies,

What are your expectations re-
garding this initiative of the Cham-
ber? Do you feel optimistic that the
changes which you initiated will be
made? What is the practice of simi-
lar initiatives of your Chamber in
the past?
E.M.Shtrbevska: One of our pri-
mary goals and tasks, as a business
association, is representation of
the mutual interests of the mem-
bers of the Chamber before the
competent state authorities and in-
stitutions, improvement of the ef-
fectiveness of their work and rais-
ing initiatives for legal and other
provisions which are significant for
the economy. For that purpose, the
established institutional coopera-
tion of the Economic Chamber of
the Republic of Macedonia with the
state authorities has always been
on a high level, with possibility for legal solution will be changed, in
continuous improvement.
Taking in consideration the pre-
vious experiences, I can say that
most of our initiatives have been
accepted, which, of course is due
to the representative scope of our
initiatives are based on concrete
demands and suggestions of the
companies, which are further de-
liberated through core analysis and
research, so that in the end con-
crete suggestions are derived on
how to overcome the disputable is-
sues which may impede the normal
functioning of the economic sub-
jects. Therefore, above all, our goal
is to suggest concrete solutions for
dealing with the perceived issues.
Under the assumption that
nothing will be changed, and hav-
ing in consideration the present
circumstances, is it possible in fu-
ture to have situation where the
private companies will decrease
the business cooperation with the
public sector, maybe they will not
apply to tenders, etc.?
E.M.Shtrbevska: If we have in
mind the fact that promptly after
the submitted initiative, we came
across a positive approach by the
Ministry of Justice, as an entity that
proposed the Law on Enforcement,
the real expectations are that this
terms of finding an appropriate
mutual solution for all concerned
parties. Each company is interested
in bigger business activities, and
the public sector needs to use the
services and products of the private
sector. Due to this mutual need, it
is ungrounded to expect any kind
of problems related to decreasing
of the cooperation of the private
companies with the public sector.
However, the issues related to this
Article are not regular and massive
occurrence, but they are detected
as a problem in many concrete cas-
es, which we believe will be over-
come in reasonable timeframe.
